1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the websites, platforms and services operated by House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"), including this website and other sites in the HALP network.

By accessing or using our websites or services, you agree to be bound by these Terms. If you do not agree, you must not use our websites or services.

We may amend these Terms at any time by publishing the amended Terms on our websites. Your continued use of our websites after publication constitutes acceptance of the amended Terms.

2. Nature of Our Services

2.1 Information and Advertising Platform

HALP operates advertising and information platforms that connect prospective buyers with property developers, builders, real estate agents, mortgage brokers and other service providers.

We are an advertising platform and information service, not a party to any property transaction
We do not sell, own, develop, or manage the properties advertised on our websites
We do not act as your agent, adviser, or representative
Listings are supplied by third-party advertisers and are their responsibility

2.2 No Professional Advice

Information on our websites is general information only. It does not take into account your objectives, financial situation or needs, and is not:

Legal advice
Financial or credit advice
Taxation advice
Investment advice
Town planning advice

You should obtain your own independent professional advice before making any decision in relation to property, finance or investment.

3. Accuracy of Information

3.1 Third-Party Content

Much of the content on our websites — including listings, prices, plans, images, inclusions, and availability — is supplied by third parties. While we take reasonable care, we do not verify, endorse or guarantee the accuracy, currency or completeness of third-party content.

3.2 Planning, Development and Government Information

Information about master-planned communities, precinct structure plans, infrastructure, schools, transport and government approvals is drawn from publicly available sources and may change without notice.

Draft plans are subject to change, exhibition, submissions, panel processes and approval
Timing of delivery of infrastructure, schools and services is indicative only
Maps, boundaries and schematics are indicative and not to scale
Artist's impressions and concept images are illustrative only and not representations of a final product

You must make your own enquiries with the relevant authority (including Victorian Planning Authority, the responsible Council and Victorian Government departments) before relying on any such information.

3.3 Estimates

Any figure identified as an estimate is a modelled or indicative figure only, is not a valuation, forecast or guarantee, and must not be relied upon for any financial decision.

4. Use of Our Websites

4.1 Permitted Use

You may use our websites for lawful, personal, non-commercial purposes, and for legitimate business purposes where you are an advertiser or partner.

4.2 Prohibited Conduct

You must not:

Use our websites in breach of any law or regulation
Scrape, harvest, data-mine or systematically extract content

Your details may be passed to the relevant advertiser, agent, developer, builder or broker
That party becomes responsible for their handling of your information and their communications with you
We may contact you regarding your enquiry and, where you have consented, with related information
We may receive a referral fee, commission or advertising fee in connection with enquiries and transactions

You acknowledge that we may be remunerated by advertisers and partners, and that this does not create any advisory or fiduciary relationship between us and you.

6. Intellectual Property

All content on our websites — including text, graphics, logos, layouts, schematics, compilations and software — is owned by or licensed to HALP and is protected by Australian and international intellectual property laws.

You may view and print content for personal, non-commercial use only. All other use requires our prior written consent.

Trademarks, business names and logos appearing on our websites are the property of their respective owners and may not be used without permission.

7. Advertiser Obligations

If you advertise on our platforms, you warrant that:

You hold all necessary licenses, registrations and insurances
All content you supply is accurate, current and not misleading or deceptive
You own or are licensed to use all content you supply, including images
Your content complies with all applicable laws, including the Australian Consumer Law, the Estate Agents Act 1980 (Vic) and equivalent legislation
Pricing, inclusions and availability are correct at the time of publication and will be updated promptly when they change

You indemnify HALP against any claim, loss or liability arising from content you supply or from your conduct in connection with our platforms.

8. Third-Party Links and Services

Our websites contain links to third-party websites and services. We provide these links for convenience only. We do not control, endorse or accept responsibility for third-party websites, their content, products, services or privacy practices.

9. Disclaimers and Limitation of Liability

9.1 Websites Provided "As Is"

To the maximum extent permitted by law, our websites and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our websites will be uninterrupted, error-free, secure, or free of viruses.

9.2 Australian Consumer Law

You indemnify and hold harmless HALP and its related bodies corporate, directors, officers, employees and agents from and against all claims, losses, liabilities, costs and expenses (including legal costs) arising from or in connection with your use of our websites, your breach of these Terms, or your breach of any law or the rights of any person.

11. Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

12. Suspension and Termination

We may modify, suspend or discontinue all or part of our websites and services at any time without notice. We may terminate or restrict your access where we reasonably believe you have breached these Terms or where required by law.

13. General

13.1 Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and courts of appeal from them.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.

13.3 Waiver

A failure or delay by us to exercise any right under these Terms does not operate as a waiver of that right.

13.4 Entire Agreement

These Terms, together with our Privacy Policy and any listing or advertising agreement, constitute the entire agreement between you and HALP in relation to your use of our websites and services.
